US court reviews Apple claim to ban Samsung tablets

A US appeal court has reviewed a recent decision that allowed Apple to pursue action that could see some Samsung tablets banned from sale.

The US Court of Appeals for the Federal Circuit said the judge in a district court in California had erred.

It is the latest development in a long-term legal battle between the pair that includes more than 20 patent-related cases in ten countries.

The patent involved in Monday's ruling is in relation to the design of Samsung's Galaxy Tab 10.1 tablet.

A US District Court in California found that the design copyright could well be challenged as "obvious", which means it should never have been granted. The appeals court disagreed.

Apple sued Samsung in the US last year, claiming that the South Korean manufacturer's Galaxy line of mobile phones and tablets "slavishly" copied the iPhone and iPad designs, a statement which led to Samsung countersuing Apple.

The battle between the pair is set to continue around the world as they look to gain the upper hand in the tablet and smartphone markets.
